These Terms & Conditions apply to the use of foreguardsafety.com and to purchases made from Foreguard. Please read them before placing an order.
1. About Foreguard
This website is operated under the trading name Foreguard. You can contact us at foreguard1@gmail.com or through our Contact page.
2. Products and information
We take reasonable care to ensure that product descriptions, specifications, images and prices are accurate. Screen settings and photography may cause minor differences in colour or appearance. Product packaging or presentation may also change without affecting the product’s essential characteristics.
Please read and follow all instructions supplied with the product. Nothing on this website is professional medical, gas-safety or emergency advice. If you suspect carbon monoxide is present, move to fresh air and follow the emergency guidance supplied with the product and from the relevant emergency services.
3. Orders and contract formation
After you place an order, we will send an acknowledgement to the email address supplied. This acknowledgement does not necessarily mean that the order has been accepted. A contract is formed when we accept and begin processing or dispatching the order.
We may decline or cancel an order before dispatch if, for example, the product is unavailable, payment cannot be authorised, the pricing or description contains an obvious error, or we reasonably suspect fraud or misuse. If payment has already been taken, the appropriate amount will be refunded.
4. Prices and payment
Prices are shown in pounds sterling and include applicable taxes unless stated otherwise. Any delivery charge will be displayed before checkout; standard UK delivery is currently free. Payment must be authorised using one of the methods offered at checkout.
5. Delivery
We currently deliver within the United Kingdom. Estimated delivery is normally 5–8 working days. Full details, including delays, tracking and incorrect addresses, are set out in our Shipping & Delivery policy.
Risk in the goods passes to you when they are delivered to you or a person you nominate. Ownership passes once full payment has been received.
6. Cancellations, returns and refunds
UK consumers normally have a statutory right to cancel an online purchase within 14 days after delivery. Foreguard also provides a voluntary 100-day money-back guarantee. The conditions, return process, refund timing and model cancellation form are explained in our Returns & Warranty policy.
7. Faulty goods and warranty
Products must be as described, of satisfactory quality and fit for purpose as required by law. Your statutory rights are not affected by these terms. Foreguard also provides a one-year limited warranty against manufacturing faults arising under normal use; exclusions and claim instructions are set out in our Returns & Warranty policy.
8. Acceptable website use
You must not misuse the website, attempt unauthorised access, knowingly introduce malicious code, interfere with its operation, or use its content for unlawful or fraudulent purposes.
9. Intellectual property
The Foreguard name, website design, copy, graphics and other original content are owned by or licensed to Foreguard and are protected by applicable intellectual-property laws. You may use the website for personal, non-commercial shopping purposes. You may not reproduce or commercially exploit its content without permission.
10. Third-party services and links
The store is hosted by Shopify and may use third-party services for payment, delivery, analytics and advertising. Links to third-party websites are provided for convenience; those services are governed by their own terms and privacy notices.
11. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to the paragraph above, Foreguard is not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a consumer purchase.
12. Events outside our reasonable control
We are not responsible for delay or failure caused by circumstances outside our reasonable control. We will take reasonable steps to minimise the effect and keep affected customers informed.
13. Privacy and cookies
Our collection and use of personal information is explained in our Privacy Policy. Information about cookies and advertising technologies is available in our Cookie Policy.
14. Changes to these terms
We may update these terms when our services, practices or legal obligations change. The terms applying to an order are those in force when the order is placed, unless a change is required by law.
15. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer elsewhere in the UK, you retain any mandatory protections and rights to bring proceedings in the courts available to you.
